Win Win Environmental warrants that all services provided hereunder shall be furnished in a manner consistent with industry standards and the level of professional skill generally acceptable in the industry with regard to services of this kind. Win Win Environmental warrants that its mitigation/prevention services will provide durable, long-term antimicrobial activity and will significantly retard microbial growth of mold on all treated surfaces. Win Win Environmental warrants that its mitigation/prevention services will control existing microbial contamination on treated surfaces and protect against future growth of fungi and microorganisms for the governing State of Florida contractor statue of repose, which is 5 Years, commencing from the date of treatment.

Except for the express warranties in the limited warranty set forth above, Win Win Environmental makes no other warranties of any kind and disclaims all other warranties, whether oral or written, express or implied, including the implied warranties of merchantability and fitness for particular purpose.

The exclusive remedy of client and the limit of the liability of Win Win Environmental for any and all losses, injury or damages resulting from the application and use of Win Win Environmental’s mitigation/prevention services (including claims based in contract, negligence, product liability, strict liability, tort or otherwise) shall be for client to haveWin Win Environmental , at its expense, remediate all open and hidden surfaces which have developed microbial growth. In no event shall Win Win Environmental be liable for any incidental, consequential, special or punitive damages.
